What Legal Options Does a Family Have After a Roadside Death in Kaufman County, TX?

When a person is killed while standing outside a disabled vehicle on a Texas highway, eligible surviving family members, including a spouse, children, and parents, may be able to pursue a wrongful death claim when a loved one is killed due to another party's negligence.

One important consideration in roadside fatality cases is how Texas's modified comparative fault system may apply to the circumstances involved. When a pedestrian enters a lane of traffic on a highway, insurers and defense attorneys may attempt to assign a portion of fault to the deceased as a way of reducing or eliminating the compensation available to surviving family members.

Under Texas law, a family may still be able to recover compensation as long as the deceased is not found to be more than fifty percent responsible for the crash. Understanding how fault may be apportioned in a specific situation, and what evidence may be relevant to that determination, is one of the most important reasons to consult a personal injury attorney as early as possible after a roadside fatality.

Beyond the question of fault, the financial losses that surviving family members may be able to pursue in a Texas wrongful death claim can be significant. The loss of future income and earning capacity, funeral and burial costs, and the lasting absence of a loved one's companionship and support are among the damages that may be considered depending on the specific circumstances involved.

Because these losses can be difficult to fully quantify in the immediate aftermath of a fatal crash, settling too early, before the investigation concludes and the full scope of the family's losses is understood, can result in compensation that falls well short of what the family may actually need.

A wrongful death lawyer familiar with Kaufman County law may be able to help surviving family members navigate this process, preserve relevant evidence, and ensure that any resolution reached reflects the full value of their loss.
